These Datadog Summit London 2025 Registration Terms and Conditions (“Terms”) govern your registration for, and participation in, the Datadog Summits to be held on March 3-4, 2025 (the “Event”). These Terms are an agreement between Datadog, Inc. (“Datadog,” “we,” “us,” or “our”) and you or the entity you represent (“you”). By completing registration on the summit registration page or participating in/attending the Event, you confirm that you have read, understood and agree to these Terms.
1. REGISTRATION
To register for the Event, you must complete the Event registration process no later than March 3-4, 2025. Event registration may close earlier than March 3-4, 2025 as we may determine in our sole discretion. Event registration is subject to availability. You must be 18 years of age or older to register for and/or attend the Event.
2. CONTACT INFORMATION
Please note that your contact details and other information (including analytics from the hosting platform) we collect through the registration process and your attendance of the Event will be processed in accordance with our Privacy Policy (https://www.datadoghq.com/legal/privacy/). Additionally, your information will be used to contact you with information related to the Event. The Event will be hosted by a third-party platform, and you understand that at the time of entering the Event the platform may require you to acknowledge and agree to additional terms for your access and use of the platform.
3. CONDUCT
By attending the Event you agree at all times to (a) not engage in disruptive behavior or otherwise interfere with the Event or other participants' enjoyment of the Event, (b) conduct yourself in a manner that promotes a safe and supportive learning environment; and (c) comply with all applicable laws. If Datadog believes that you will not comply with the above, then Datadog may deny you entry or require that you leave the Event and you shall not receive a refund of any fees paid, if applicable. Should you witness detrimental actions of other Event participants or have reason to believe such actions may occur, you shall promptly inform a Datadog staff member. Event attendees will have the opportunity to participate in Q&A sessions through the Event platform. Datadog will be monitoring all comments, questions or other responses submitted during a Q&A session and reserves the right to remove or modify any of your contributions, particularly with respect to any content Datadog considers to be inappropriate, profane, harassing or otherwise in violation of these Terms.
4. EVENT CANCELLATION
The Event is subject to change and Datadog may cancel the Event and may deny or cancel a registration for the Event at any time, at its sole discretion. Datadog disclaims any and all liability for any damages resulting from such cancellation.
5. RECORDING AND YOUR MATERIALS
In consideration of the opportunity to participate in the Event, you hereby grant Datadog, its affiliates, agents, employees, independent contractors and assigns an irrevocable, perpetual, worldwide, nonexclusive, royalty-free right and license to edit, publish, reproduce, distribute or translate, for any purpose, all or any part of (a) any and all photographs, audio and video recordings of you and/or your voice or likeness in connection with the Event, including the right to use your name, likeness and biographical information, and (b) all materials submitted or presented by you in connection with the Event (collectively, “Materials”). You represent and warrant that (a) your Materials are true and accurate to the best of your knowledge, (b) you have the necessary rights and permissions to grant the license in this Section 6, and (c) your Materials do not violate or infringe any copyright, trademark, or other proprietary rights of any person or entity. You hereby consent to Datadog's use of the Materials without compensation or additional consents from you (unless required by law). Additionally, Datadog may restrict you from taking any photographs, audio and video recordings while attending the Event.
6. RELEASE OF CLAIMS
You (for yourself and anyone who may make a claim on your behalf) hereby release Datadog and its affiliates, and their respective directors, representatives, agents, officers, employees, contractors, successors and assigns, from any and all claims, demands, causes of action, losses, suits, damages, debts, liabilities, costs and expenses (including reasonable attorneys' fees and costs) (together, “Losses”) that you may have now or in the future associated in any way with the Event or Materials. You acknowledge that Datadog will be relying upon a third-party provider for the webhosting of the Event. While Datadog has made all reasonable efforts to procure a secure and high-performance platform, you agree that Datadog is not liable for any interruptions, delays, errors, inaccuracies or other technical or security issues associated with the hosting platform of the Event and you release Datadog from any Losses arising out of or in connection with the same.
7. ASSUMPTION OF RISK
You acknowledge that your attendance and participation in the Event is on a voluntary basis. You hereby assume all risks, known and unknown, associated with attending and participating in the Event to the fullest extent permitted under law. An inherent risk of exposure to COVID-19 exists in any public place where people are present. Although Datadog has instituted reasonable practices in an attempt to lessen or reduce the spread of COVID-19, Datadog cannot guarantee that you will never get exposed to the virus or get sick from it. By attending a Datadog event, you voluntarily assume all risks related to exposure to COVID-19.
8. LIMITATION OF LIABILITY
IN NO EVENT SHALL (a) DATADOG BE LIABLE FOR ANY LOSS OF DATA, LOSS OF PROFITS, OR OTHER SPECIAL, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL, INDIRECT, PUNITIVE, OR RELIANCE DAMAGES OR (b) THE LIABILITY OF DATADOG FOR DIRECT DAMAGES UNDER THESE TERMS EXCEED $200.
9. INDEMNIFICATION
You shall defend, indemnify and hold harmless Datadog, its affiliates, and their respective directors, representatives, agents, officers, employees, contractors, successors and assigns, from and against any Losses arising out of or related to your attendance, participation or conduct at the Event.
10. SANCTIONS
You represent and warrant that you are not subject to sanctions or otherwise designated on any list of prohibited, restricted, or excluded parties or owned or controlled by such a party, including but not limited to the lists maintained by the United Nations Security Council, the US Government, the European Union or its member states, or other government authority.
11. CHOICE OF LAW AND VENUE
These Terms will be interpreted, construed and enforced in all respects in accordance with the laws of the State of New York, without reference to its choice of law principles. Any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in New York City, New York, USA, and you expressly consent to personal jurisdiction and venue in those courts.
12. AMENDMENT OF TERMS
For the avoidance of doubt, these Terms supersede any previous terms in connection with the Event. Datadog may modify these Terms at any time by providing notice to you or by posting a revised version on the Datadog Summit London registration website. By participating in the Event, you agree to the current version of these Terms posted on that website.
